THESE TERMS OF SERVICE CONTAIN PROVISIONS THAT LIMIT OUR LIABILITY TO YOU AND REQUIRE YOU TO RESOLVE ANY DISPUTE WITH US THROUGH FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS OR REPRESENTATIVE ACTION. SECTION 4 – REGISTRATION AND USER INFORMATION
To create an account on our Site, you must be at least 18 years old and provide accurate and complete personal information. As part of our commitment to preventing underage sales, we employ third-party age verification services to confirm your age before allowing purchases. You may be required to provide valid identification documents, and we may implement additional verification steps before processing orders. We reserve the right to refuse service if age verification cannot be completed satisfactorily. You may also be asked to provide a username and password. You are solely responsible for maintaining the confidentiality of your password. You may not use the account, username, or password of someone else at any time. You are also solely responsible for any and all activities that occur under your registration or your User Information. You agree to notify us immediately of any unauthorized use of your account, username, or password.
You are responsible for maintaining the confidentiality of your account password and must not share your account credentials with others. You agree to notify us immediately if you become aware of any unauthorized access to your account. You will be responsible for all activities that occur under your account, whether or not you authorized such activities.
Only one account per person is permitted, and you must not create accounts on behalf of others. We may suspend or terminate accounts that violate these terms, and we reserve the right to refuse service to anyone at our discretion. You must keep your account information current and promptly update any changes to your contact details. Failure to maintain accurate information may result in account suspension.
We reserve the right to terminate accounts without prior notice and may refuse service to users who have previously violated our terms. You may request account deletion, though we may retain certain information as required by law or for legitimate business purposes.
SECTION 5 – ORDERS AND PAYMENT
By placing an order through the Site, you are offering to purchase products subject to these Terms of Service. All orders must pass our age verification process and are subject to acceptance by us. We will confirm our acceptance of your order by sending you an order confirmation email, at which point a contract of sale will be formed between us. We reserve the right not to accept your order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
All prices displayed on our Site are in British Pounds Sterling (GBP) and include Value Added Tax (VAT) at the applicable rate. Shipping costs will be added to the total amount of your order and will be clearly displayed before you complete your purchase. We accept payment through various methods as displayed on our Site, and you warrant that you are authorized to use your chosen payment method.
If you dispute any payment made to us, you must contact us within ten (10) days of the payment date. You agree that failure to notify us of a dispute within this timeframe constitutes a waiver of any claims related to that payment. In the event of non-payment or late payment, you agree to pay all costs of collection, including reasonable legal fees, incurred by us in attempting to collect any amounts due.
We reserve the right to limit the quantity of products sold, restrict sales to particular geographic regions within the UK, and modify product prices at any time without notice. Product descriptions and specifications are subject to change without prior notification. We do not guarantee that the quality of products, services, information, or other materials purchased will meet your expectations. We may discontinue any product at any time.
For your protection and to prevent fraud, we may require additional verification or information before accepting certain orders. We reserve the right to refuse transactions that we reasonably believe to be fraudulent or unauthorized.
SECTION 6 – DELIVERY AND SHIPPING TERMS
We deliver our products only within the United Kingdom mainland. We currently do not ship to PO boxes, BFPO addresses, the Channel Islands, or Northern Ireland. Delivery times shown during checkout are estimates and not guaranteed delivery dates. Standard delivery typically takes 1-2 working days, while next-day delivery orders must be placed before 2 PM on a working day.
The risk of loss and title for products purchased from our website passes to you upon our delivery to the carrier. We are not responsible for any delays caused by the shipping carrier; however, we will assist you in tracing your delivery if there are any issues.
If your package appears damaged upon delivery, please note this when signing for delivery and inspect the contents immediately. Any external damage or missing items should be reported to us within 24 hours of delivery. For packages that are lost in transit, we will either replace the items or provide a full refund once the shipping carrier confirms the loss.
We reserve the right to refuse delivery or charge shipping fees to attempted deliveries to any address we reasonably believe is being used to violate our age verification policies or other terms of service. All deliveries require a signature from someone aged 18 or over, with valid ID if requested. If no one is available to receive and sign for the delivery, a card will be left with instructions for redelivery or collection.
Free shipping may be available for orders over a certain value, as advertised on our website. We may also run promotional shipping offers from time to time. These offers may be withdrawn or modified at any time.
If your order has not arrived within the estimated delivery timeframe, please contact our customer service team. We will investigate the delay and keep you informed of the status of your delivery. If we are unable to deliver your order within 7 days, you may cancel your order and receive a full refund.
SECTION 7 – RETURNS AND REFUNDS
Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods (the "cooling-off period"). To exercise this right, you must inform us in writing of your decision to cancel. You then have 14 days to return the goods to us.
For hygiene and safety reasons, we cannot accept returns of e-liquid products, cartridges, or pods that have been opened or had their seals broken (i.e. packaging has been open). Device returns will only be accepted if they are unopened, unused, and in their original packaging with all seals intact. This restriction on returns does not affect your rights in relation to faulty or incorrectly described products.
To return a product, it must be:
In its original, unopened packaging
In a resalable condition
Accompanied by the original proof of purchase
Returned within 14 days of informing us of cancellation
Once we receive your return, we will inspect the items and process your refund within 14 days. The refund will be made to the original payment method used for the purchase. The refund will include the original delivery charge, except where you are only returning part of your order or chose a premium delivery option. At our discretion, we may choose to reimburse your return shipping costs.
For faulty products, your legal rights under the Consumer Rights Act 2015 are not affected by our returns policy. If you receive a faulty product, please contact our customer service team immediately. We will arrange for the return and either provide a replacement or full refund, including any reasonable return shipping costs.
Please note that certain promotional items, customized products, or items marked as non-returnable at the time of sale cannot be returned unless they are faulty. For hygiene reasons, we also cannot accept returns of any products where the tamper-evident seal has been broken.
If you wish to return a product, please contact our customer service team for a return authorization and shipping instructions. Returns sent without prior authorization may be refused. We recommend using a tracked delivery service as we cannot be responsible for items lost in transit during return shipping.
SECTION 8 – AGE VERIFICATION PROCESS
As required by UK law, we employ strict age verification procedures to ensure our products are only sold to individuals aged 18 or over. By using our Site and attempting to purchase our products, you confirm that you are at least 18 years old.
Our age verification process includes multiple steps:
At Registration and Purchase:
You must provide your full name, date of birth, and current UK address
We may require additional documentation to verify your age
Attempting to circumvent our age verification process is strictly prohibited
Acceptable Forms of ID:
Valid UK passport
UK photocard driving licence
National Identity card
Military ID card
Other government-issued photo ID
Delivery Verification:
All deliveries may require a signature from someone aged 18 or over
Delivery personnel may request proof of age
Packages will not be left unattended or with persons under 18
Orders may be returned if age verification fails at delivery
We reserve the right to:
Refuse service if we cannot verify your age
Cancel orders where age verification fails
Report attempted underage purchases to relevant authorities
Request additional verification at any time
Refuse future service where false information has been provided
Charge for delivery attempts where age verification fails at delivery
Making false declarations about your age or attempting to purchase on behalf of someone under 18 is a criminal offence. Any suspected attempts to purchase products for minors will be reported to the relevant authorities.
If you cannot provide appropriate age verification when requested, your order will be cancelled and refunded, less any verification fees incurred. Repeated failed verification attempts may result in account suspension.
SECTION 9 – PRODUCT WARRANTY
Battery Warranty: We provide a one-year limited warranty on the battery device from the date of purchase. This warranty covers manufacturing defects and malfunctions under normal use conditions. The warranty is valid only with proof of purchase from an authorized retailer and is non-transferable.
This warranty does not cover:
Normal wear and tear
Damage from accidents, misuse, or unauthorized modifications
Water damage or exposure to liquids
Cosmetic damage including scratches and dents
Damage from using non-Company approved chargers, pods, or accessories
Battery devices with removed or tampered serial numbers
Pods and Consumables: Due to their consumable nature, pods do not carry an additional warranty beyond your statutory rights under UK consumer law. Your statutory rights relating to faulty or incorrectly described goods are not affected by this warranty policy.
To make a warranty claim:
Contact our customer service team
Provide your proof of purchase
Describe the issue with your device
Follow our instructions for returning the product
For valid warranty claims, we will either repair or replace the defective device at our discretion. If an identical replacement is not available, we may replace it with a similar product of equal or greater value.
Your statutory rights under the Consumer Rights Act 2015 remain unaffected by this warranty. This means you are entitled to request a repair or replacement if goods are faulty or not as described, regardless of any additional warranty coverage.

All content featured on our Site, including but not limited to text, graphics, logos, images, audio, video, software, and website design, is owned by or licensed to us and is protected by UK and international intellectual property laws. You agree not to copy, reproduce, modify, create derivative works from, distribute, or publicly display any content from our Site without our prior written consent. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by us or our licensors, except for the limited license expressly granted above.
SECTION 11 – THIRD-PARTY LINKS
Our Site may include content, materials, or links to third-party websites, products, or services that we do not own or control. We do not review all content provided by third parties and are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites. We are not liable for any harm or damages related to the purchase or use of third-party goods, services, websites, content, or any other materials available through third-party sources.
When you click on a third-party link, you may leave our Site. These external sites have their own terms of service and privacy policies, which may differ from ours. We strongly encourage you to review the terms and policies of any third-party website you visit. Your interactions with third-party websites, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and the third party.
We provide these links and content for your convenience only. The inclusion of any link or content does not imply our endorsement, sponsorship, or recommendation of that site or the products or services it offers. You agree to use third-party content and links at your own risk and acknowledge that we will not be party to any transaction between you and third-party providers.
SECTION 12 – USER CONTENT
By posting, uploading, submitting, or otherwise sharing any content on our Site, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content across our platforms and promotional materials. You confirm that you have all necessary rights to grant us this license and that your content does not infringe upon any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights.
You are solely responsible for any content you provide and its accuracy. You agree that your content will not be unlawful, abusive, obscene, or harmful to others. You must not submit content that contains malware, viruses, or other malicious code, nor use false contact information or impersonate others. We reserve the right to monitor, edit, or remove any content that we determine, in our sole discretion, violates these terms or is otherwise objectionable.
We are not obligated to maintain or store your content. While we strive to provide a platform for user interaction, we do not guarantee that your content will always be available or restored if removed. You retain ownership of your content, but we are not liable for any loss or damage to user content, nor are we responsible for any errors or omissions in content posted by users.
By submitting content, you acknowledge that it may be viewed by other users and could be used by third parties. You should exercise caution when deciding to disclose any personal information in your content. We take reasonable measures to protect user content but cannot guarantee its absolute security.
SECTION 13 – MODIFICATIONS
We reserve the right to modify, update, or discontinue any aspect of our Site, Services, and Products at any time without prior notice. This includes changing or removing features, adjusting pricing, modifying specifications, or discontinuing product lines. We may also impose limits on certain features or restrict access to parts or all of the Site without notice or liability.
We strive to ensure our Site and Services remain available and functional, but we cannot guarantee uninterrupted access. Maintenance, updates, or other technical issues may result in temporary interruptions to our Services. While we will make reasonable efforts to notify you of significant changes or interruptions, we are not liable for any loss or inconvenience that may result from such modifications or discontinuations.
SECTION 14 – PRIVACY AND DATA PROTECTION
The protection of your personal information is important to us. Our handling of your personal data is governed by our Privacy Policy, which can be found at https://nosaint.co/en-uk/privacy. By using our Site and Services, you consent to our privacy practices as described in our Privacy Policy. We encourage you to read our Privacy Policy carefully as it forms an essential part of our agreement with you and outlines how we collect, use, share, and protect your personal information.
SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS
Our Site may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and product availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after you have submitted an order. In such cases, we will notify you of any changes affecting your order and provide you with options regarding your purchase.
If we discover an error in the price of products you have ordered, we will inform you and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and have already paid for the products, you will receive a full refund.
This provision does not affect your statutory rights as a consumer under UK law, including your right to receive goods that match their description, are of satisfactory quality, and are fit for purpose.
SECTION 16 – PROHIBITED USES
You agree not to use our Site and Services for any unlawful purpose or in any way that violates these Terms of Service. You must not use our Site to engage in any activity that breaches applicable UK laws or regulations, including those relating to tobacco and nicotine products. You are prohibited from using the Site to impersonate others, submit false information, or attempt to circumvent our age verification processes.
You must not attempt to interfere with the proper functioning of the Site or bypass any security measures we have in place. This includes uploading malicious code, attempting to gain unauthorized access to our systems, or engaging in any activity that could disable, damage, or impair the Site's functionality. You are also prohibited from collecting or harvesting any personal information from the Site or using our platform to transmit unsolicited commercial communications.
We take any misuse of our Site seriously and reserve the right to suspend or terminate access for users who engage in prohibited activities. We may also report serious breaches to relevant authorities where we have a legal obligation to do so or where we believe illegal activity has occurred.
SECTION 17 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
While we make reasonable efforts to ensure the quality of our Site, Products, and Services, they are provided on an "as is" and "as available" basis. We do not guarantee that your use of our Site will be uninterrupted, timely, secure, or error-free. We may need to suspend access to our Site for maintenance, technical issues, or other reasons.
We will take all reasonable steps to provide accurate product information, but technical inaccuracies or typographical errors may occur. Images of products on our Site are for illustrative purposes only, and actual products may vary slightly from these images. We do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.
To the fullest extent permitted by applicable UK law, we exclude all conditions, warranties, representations, or other terms which may apply to our Site or any content on it, whether express or implied. We will not be liable to any user for any loss or damage arising under or in connection with the use of, or inability to use, our Site or Services. This includes:
Loss of profits, sales, business, or revenue
Business interruption
Loss of anticipated savings
Loss of business opportunity or goodwill
Indirect or consequential loss
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. This includes your statutory rights as a consumer.
Our total liability to you for any losses arising from our breach of these Terms shall be limited to the greater of (a) the total amount paid by you for products purchased through our Site in the month preceding the event giving rise to the liability, or (b) £100.
SECTION 18 – INDEMNIFICATION
You agree to indemnify and hold harmless our company, our parent, subsidiaries, affiliates, partners, officers, directors, employees, and suppliers from any claim or demand, including reasonable legal fees, made by any third party due to or arising from your breach of these Terms of Service, your violation of any law or regulation, or your violation of any third party's rights. This includes any claims arising from your misuse of our products, your submission of inaccurate age verification information, or your unauthorized modification of our products.
We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate in asserting any available defences. You agree to pay all reasonable costs incurred by us in the defence of such claims, including legal fees. Nothing in this section shall prevent us from seeking injunctive or other equitable relief.
This indemnification obligation will survive the termination or expiration of these Terms of Service and your use of our Site and Services.
SECTION 19 - GOVERNING LAW
These Terms of Service and any separate agreements through which we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any dispute or claim arising out of or in connection with these Terms or their subject matter or formation shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Your use of the Site and any dispute arising out of such use of the Site is subject to the laws of England and Wales. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of your local law.
SECTION 20 – DISPUTE RESOLUTION
If you have a complaint about our products or services, we encourage you to contact our customer service team first at support@nosaint.co. We will strive to resolve any issues promptly and fairly through direct communication.
If we cannot resolve your complaint through our customer service channels, you have the right to seek alternative dispute resolution. As required by EU and UK law, we will inform you about the certified alternative dispute resolution provider and whether we intend to use them to resolve the dispute. You may also use the European Commission's Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/.
Nothing in these Terms prevents you from seeking advice from a consumer advice organization or bringing legal proceedings in the courts of England and Wales. You may also have the right to bring legal proceedings in your country of residence if different from the UK.
We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with our service or have any other complaint, please contact us using the details provided above.
SECTION 21 – GROUP LITIGATION
While collective redress mechanisms are available under UK law, any legal action or proceeding arising under these Terms shall be brought on an individual basis. This means that you may only bring claims against us in your individual capacity and not as a plaintiff or class member in any purported class, collective, representative, multiple plaintiff, or similar proceeding.
You expressly waive any ability to maintain any class action in any forum. Any dispute resolution proceeding will be conducted only on an individual basis through the appropriate courts of England and Wales. However, nothing in these Terms affects your statutory rights as a consumer under applicable UK law, including any rights you may have under the Consumer Rights Act 2015.
SECTION 22 – SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions. The invalid or unenforceable provisions shall be replaced by valid and enforceable provisions that most closely match the intent of the original provisions.
SECTION 23 – OTHER TERMS
These Terms of Service, together with any policies or operating rules posted on our Site, constitute the entire agreement between you and us and govern your use of our Services. This agreement supersedes any prior agreements, communications, or proposals, whether oral or written, between you and us. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
SECTION 24 – CHANGES TO TERMS OF SERVICE
We may update, modify, or replace any part of these Terms of Service by posting updates or changes to our Site. It is your responsibility to check our Site periodically for changes. The date of the most recent revisions will appear at the top of this page. Your continued use of or access to our Site following the posting of any changes constitutes acceptance of those changes.
We will make reasonable efforts to notify you of any significant changes to these Terms by displaying a notice on our Site or sending you an email. However, you should review these Terms regularly to ensure you are aware of any changes.
SECTION 25 – MISCELLANEOUS
These Terms operate to the fullest extent permitted by law. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to others at any time. If we provide a translation of these Terms, the English version will control in case of any conflict.
We shall not be responsible or liable for any failure to perform or delay in performing our obligations under these Terms that is caused by events outside our reasonable control. No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by these Terms.
If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
SECTION 26 – CONTACT INFORMATION AND NOTICES
All notices to us must be in writing and sent by recorded delivery mail to our registered office or by email to the address below. We may give notice to you via the email address you provide to us through your account.
